GTC

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the online shop schweizversand.ch (hereinafter “Online Shop”) of Optitrade & Service AG (hereinafter “we” or “us”).

Our offer is exclusively aimed at customers with a residential or company address in Switzerland or Liechtenstein. Deliveries are only made to addresses in these two countries.

By placing an order in the Online Shop, you acknowledge the version of these GTC valid at the time of the order. Deviating conditions of the customer are not recognized.

2. Conclusion of Contract

The presentation of the products in the Online Shop does not constitute a legally binding offer, but an invitation to order. The contract is concluded as soon as you place your order in the Online Shop and it is accepted by us through an order confirmation via email.

This order confirmation does not contain a promise that the product can actually be delivered. It only confirms the receipt of your order. The conclusion of the contract is subject to the possibility of delivery and the correct price indication.

3. Prices and Shipping Costs

All prices in the Online Shop are quoted in Swiss Francs (CHF) and include the statutory value-added tax. The prices are binding at the time of the order.

In addition to the stated prices, shipping costs apply. These amount to a flat rate of CHF 9.90 per order. For orders with a net value of CHF 50.00 or more, shipping is free.

4. Payment Conditions

Payment is made in advance to the account specified in the order confirmation. For payments made at the post office counter, the resulting fees are to be borne by the customer.

5. Delivery and Delivery Times

Delivery is generally made by the courier service DPD. For items that cannot be sent as a parcel, we commission a freight forwarder. The delivery of freight items is made to the curbside.

Orders paid by 2:00 PM are generally dispatched on the next working day. However, information on delivery times is non-binding and may be delayed in exceptional cases (e.g., due to delivery bottlenecks).

Should we be in default of delivery, you have the right to withdraw from the contract from the 30th calendar day after the originally announced delivery date. In this case, we will refund any amounts already paid. Further claims are excluded.

6. Inspection Obligation and Notification of Defects

You are obliged to check the delivered products for correctness, completeness, and any damage immediately upon receipt. Defects or incorrect deliveries must be reported to us by email to webshop@schweizversand.ch within 5 calendar days of delivery. Damaged products must not be put into operation.

7. Right of Return

You have the right to return ordered products to us within 7 calendar days of dispatch. The costs for the return shipment are to be borne by you.

The products must be in perfect, unused condition and returned with all accessories in the original packaging. If these conditions are met, we will refund the purchase price in the form of a merchandise voucher (online coupon). A cash payment or bank transfer is excluded.

8. Warranty

We provide a warranty for a period of 2 years from delivery for the freedom from defects and functionality of the ordered products. The warranty does not cover damage caused by normal wear and tear, improper handling, or external influences (e.g., moisture, falls). Also excluded are wearing parts such as ball bearings, wheels, handles, etc.

In the event of a warranty claim, we reserve the right to provide the warranty through free repair, an equivalent replacement, or a refund of the purchase price in the form of a credit note.

9. Liability

Any further liability for direct or indirect damages arising from the use of the products or access to our website is excluded to the extent permitted by law.

10. Data Protection

The processing of personal data is regulated in our privacy policy. This is an integral part of these GTC.

11. Final Provisions

Should individual provisions of these GTC be or become ineffective, the effectiveness of the remaining provisions shall not be affected.

12. Place of Jurisdiction and Applicable Law

All legal relationships between Optitrade & Service AG and the customer are subject to substantive Swiss law. The Vienna Convention on Contracts for the International Sale of Goods is expressly excluded.

The place of jurisdiction for all disputes is Muri (AG).
