GTC
1. Scope of application
These General Terms and Conditions (GTC) apply to all orders and contracts concluded through the schweizversand.ch online shop (hereinafter the “Online Shop”) operated by Optitrade & Service AG (hereinafter “we” or “us”).
Our offer is intended exclusively for customers whose residential or business address is in Switzerland or Liechtenstein. Deliveries are made only to addresses in these two countries.
By placing an order in the Online Shop, you accept the version of these GTC in force at the time of the order. Any deviating terms and conditions of the customer are not accepted.
2. Conclusion of the contract
The presentation of products in the Online Shop does not constitute a legally binding offer, but an invitation to place an order. By submitting the order, you make a binding offer to enter into a purchase contract. The automatically generated acknowledgement or order confirmation initially confirms only that your order has been received.
The purchase contract is concluded when we expressly confirm the order or dispatch the goods. Conclusion of the contract is subject to availability and to the correction of obvious pricing, typographical or transmission errors.
3. Prices and shipping costs
All prices in the Online Shop are stated in Swiss francs (CHF) and include statutory value added tax. The prices applicable at the time of the order are binding.
Shipping costs are charged in addition to the stated prices. These amount to a flat rate of CHF 9.90 per order. Shipping is free for orders with a net value of CHF 50.00 or more.
4. Payment terms
The payment methods displayed in the Online Shop when the order is completed are available. Depending on the selected payment method, additional terms of the relevant payment service provider may apply. Any fees charged for payments made at a post office counter are borne by the customer.
5. Delivery and delivery times
Delivery is generally made by the Planzer Paket courier service. For items that cannot be sent as parcels, we commission a freight carrier. Freight items are delivered to the kerbside.
Orders paid by 2:00 p.m. are generally dispatched on the next working day. Delivery-time information is non-binding, however, and delays may occur in exceptional cases, for example due to supply shortages.
If we are in default of delivery, you may withdraw from the contract from the 30th calendar day after the delivery date originally announced. In this case, we will refund any amounts already paid. Further claims are excluded to the extent permitted by law.
6. Duty to inspect and notification of defects
You must inspect the delivered products immediately upon receipt for correctness, completeness, visible defects and transport damage. Visible defects, transport damage or incorrect deliveries must be reported to us within 5 calendar days of delivery by email to webshop@schweizversand.ch. Hidden defects must be reported immediately after discovery. Damaged products must not be put into operation.
7. Right of return
You may return ordered products to us within 7 calendar days of receipt. The return is made at the customer’s cost and risk.
The products must be in perfect, unused condition and returned complete, with all accessories and in their original packaging. Following a successful inspection, we generally refund the purchase price in the form of a merchandise voucher (online coupon). A refund to the payment method selected for the order will be made only in justified exceptional cases and at our discretion. Any mandatory statutory refund rights remain reserved.
8. Warranty and bring-in warranty
We provide a warranty for freedom from defects and proper functioning of the ordered products for 2 years from delivery, unless a different warranty period is stated. In particular, the warranty excludes damage resulting from normal wear and tear, improper use or handling, failure to follow operating or care instructions, external influences such as moisture or impact, and unauthorised modifications or repairs. Wearing parts such as ball bearings, wheels or handles are also excluded unless a material or manufacturing defect can be demonstrated.
A bring-in warranty applies. When asserting a statutory or contractual warranty claim, the customer is responsible for sending the affected product, at their own expense and securely packaged for transport, to the return address specified by us, or for delivering it there. Unpaid shipments or shipments sent without prior contact may be refused. Shipment to us is at the customer’s cost and risk.
After receipt, we inspect the product and, taking into account the nature of the defect, decide whether to fulfil the claim by repair, replacement with an equivalent product or credit. Credit is generally issued as a merchandise voucher. In justified exceptional cases, a refund may be made to the payment method selected for the order. If the claim is justified, we bear the cost of sending the repaired or replacement product back to the customer. If no defect covered by warranty is found, inspection, handling and return-shipping costs may be charged to the customer.
9. Liability
Liability for direct or indirect damage and consequential loss arising from use of the products or access to our website is excluded to the extent permitted by law. Liability for intent, gross negligence and cases in which exclusion of liability is not permitted by law remains reserved.
10. Data protection
The processing of personal data is governed by our privacy policy, which forms an integral part of these GTC.
11. Final provisions
If individual provisions of these GTC are or become invalid, the validity of the remaining provisions will not be affected.
12. Place of jurisdiction and applicable law
All legal relationships between Optitrade & Service AG and its customers are governed by substantive Swiss law. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
To the extent permitted by law, the place of jurisdiction for all disputes is Muri (AG). Mandatory statutory places of jurisdiction remain reserved.
